1. Acceptance of These Terms
These Terms and Conditions (the "Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you," "your," or the "Visitor"), and Sherwin Vishesh Jathanna ("Owner," "we," "us," or "our"), the sole creator, author, and proprietor of this website, concerning your access to and use of this website, together with any content, functionality, media, and services offered on or through it (collectively, the "Website").
By accessing, browsing, or otherwise using the Website in any manner, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms in their entirety. If you do not agree with any provision of these Terms, you are expressly prohibited from using the Website and must discontinue use immediately. Your continued use of the Website constitutes your ongoing acceptance of these Terms as they may be amended from time to time.
2. Definitions
For the purposes of these Terms: "Content" means any and all text, source code, software, scripts, project descriptions, portfolio write-ups, biographical information, articles, blog posts, essays, photographs, images, illustrations, graphics, logos, animations, audio, video, page layouts, typography selections, color schemes, and any other material appearing on or forming part of the Website. "Projects" means the software applications, platforms, tools, prototypes, research, and other works created by or attributed to Sherwin Vishesh Jathanna that are displayed, described, demonstrated, or linked to on the Website. "Design" means the overall look and feel of the Website, including without limitation its visual style, layout, structure, navigation, user interface, user experience, interactive elements, and aesthetic presentation, whether considered individually or as a whole.

The Website and all Content, Projects, and Design elements contained herein are the sole and exclusive intellectual property of Sherwin Vishesh Jathanna, unless explicitly stated otherwise. All information presented on this Website, including biographical details, professional history, achievements, writings, and creative works, pertains to and is owned by Sherwin Vishesh Jathanna. No provision of these Terms, and no act of accessing or using the Website, shall be construed as transferring, assigning, or licensing any ownership interest in the Website or its Content to any Visitor or third party.
4. Scope of Copyright Protection
The Website and its Content are protected under the copyright laws of the United States of America, including without limitation the Copyright Act of 1976, as amended (Title 17 of the United States Code). Protection extends to both published and unpublished works, and arises automatically upon creation and fixation of the work, whether or not a formal registration has been filed.

Except as expressly permitted in Section 7 of these Terms, you may not, and you agree that you will not, directly or indirectly, in whole or in part:
- copy, reproduce, duplicate, scrape, harvest, mirror, frame, or otherwise appropriate any Content from the Website by any means, whether manual or automated;
- distribute, republish, upload, post, transmit, sell, license, sublicense, rent, lease, lend, or otherwise make available any Content to any third party;
- modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based upon the Website, its source code, or any Content;
- download, extract, or archive any portion of the Website for the purpose of redistribution, republication, or reuse in any other work, product, or service;
- reproduce, imitate, or exploit the Projects showcased on the Website, or represent any Project, in whole or in part, as your own work, whether in a portfolio, application, academic submission, commercial product, or any other context;
- remove, alter, obscure, or circumvent any copyright notice, attribution, or other proprietary designation appearing on or embedded within any Content; or
- use any Content or Project for any commercial purpose whatsoever without the prior express written authorization of Sherwin Vishesh Jathanna.
Any use of the Website or its Content not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other applicable laws.
6. Protection of the Website Design
The Design of this Website is original, distinctive, and proprietary, and it constitutes a protectable work of authorship in its own right. You are expressly prohibited from cloning, copying, imitating, replicating, or substantially reproducing the Design, or any distinctive element thereof, for use in any other website, application, template, theme, or digital product, whether personal or commercial, and whether or not such use is accompanied by attribution. This prohibition applies to the Design as perceived visually by a user as well as to the underlying code, styling, markup, and structural implementation that produce it. The creation of any website or product that a reasonable observer would regard as confusingly or substantially similar to this Website is strictly prohibited.
7. Permitted Uses
You are granted a limited, revocable, non-exclusive, non-transferable permission to access and view the Website and its Content solely for your personal, non-commercial, informational purposes. You may share hyperlinks that point directly to the Website or to pages within it, provided that such sharing is done in good faith, does not misrepresent the origin or ownership of the Website or its Content, does not suggest any affiliation with, sponsorship by, or endorsement from Sherwin Vishesh Jathanna where none exists, and does not present the Website or any Content as your own work. The presentation of any Project on this Website is for informational and portfolio purposes only and does not constitute an offer, license, or invitation to use, copy, commercialize, or exploit that Project. Where a Project has been released under an open source license in a separate repository, the terms of that specific license govern the code in that repository only, and nothing in that license extends to the Content or Design of this Website.
9. No License or Other Rights Granted
Except for the limited permission expressly set forth in Section 7, nothing contained on the Website shall be construed as conferring, by implication, estoppel, or otherwise, any license or right under any copyright, trademark, patent, trade secret, or other intellectual property right of Sherwin Vishesh Jathanna or any third party. All rights not expressly granted herein are reserved.
10. Name and Personal Identity
The name "Sherwin Vishesh Jathanna," together with any associated personal branding, likeness, photographs, and biographical material appearing on the Website, identifies a real individual and may not be used in any manner that is false, misleading, defamatory, or that implies endorsement, affiliation, or association without prior written consent.

The Website may contain links to third-party websites, repositories, platforms, and services, including without limitation GitHub, LinkedIn, and external publications. Such links are provided solely for your convenience. Sherwin Vishesh Jathanna does not control, endorse, or assume responsibility for the content, accuracy, policies, or practices of any third-party website. Your use of any third-party website is at your own risk and is governed by the terms and policies of that website. Any third-party trademarks, logos, or icons displayed on the Website remain the property of their respective owners, and their appearance does not imply any affiliation or endorsement.
12. Third-Party Photographs; Representational Use and Takedown Requests
Notwithstanding any other provision of these Terms, certain photographs and images appearing on the Website, including without limitation certain thumbnails accompanying feed posts, concert and event imagery, and other illustrative media, are not owned by Sherwin Vishesh Jathanna and are displayed solely for representational, illustrative, and informational purposes. All such photographs and images are, and shall remain, the sole property of their respective copyright holders. The appearance of any such material on the Website does not constitute a claim of ownership or authorship by the Owner, does not imply any affiliation with, sponsorship by, or endorsement from the respective rights holders, and is not intended to infringe upon any copyright or other proprietary right. Nothing in Section 3 or Section 4 of these Terms shall be construed as asserting ownership over such third-party material.
If you are the owner of any photograph or image appearing on the Website, or an agent authorized to act on behalf of such an owner, and you believe that your work has been displayed in a manner that constitutes copyright infringement, please notify Sherwin Vishesh Jathanna by email at sjathann@asu.edu. Takedown requests should identify the specific material at issue, describe its location on the Website, and include a statement of your ownership of, or authority over, the work in question. Upon receipt of a good-faith takedown request, the Owner will review the material promptly and, where appropriate, remove or replace it expeditiously and without dispute.
13. AirTouch and Optional Camera Features
The Website offers an optional feature known as AirTouch, which allows you to move the cursor, click, and scroll using hand gestures in place of a mouse or trackpad. AirTouch is disabled by default and never activates on its own. It runs only after you deliberately enable it from the navigation menu and grant your browser's camera permission, and it stops the moment you disable it, close the tab, or navigate away. Declining the camera permission carries no consequence of any kind, and every page, project, and word on the Website remains fully available to you if you do.
No data of any kind is collected through AirTouch. The hand tracking runs entirely within your own browser, on your own device. No image, video, frame, gesture, or derived coordinate is transmitted to the Owner or to any third party, and none is recorded, stored, or retained anywhere. No server is involved at any point. AirTouch performs no biometric identification and creates no faceprint, handprint, or other biometric template or identifier. It writes nothing to your device's storage, keeps no settings or preferences between visits, and leaves no trace once you leave the Website. The Owner has no means of determining whether you have used the feature at all. The handling of information in connection with AirTouch is described more fully in the Privacy Policy.
AirTouch is offered as a convenience and as a demonstration of the Owner's work, on an "as is" and "as available" basis, and is subject in all respects to the disclaimer of warranties and the limitation of liability set forth in Sections 15 and 16 of these Terms. Gesture recognition depends upon your camera, your lighting, and your hardware, and no representation or warranty is made that it will function accurately, continuously, or without error. You are solely responsible for deciding whether to enable the feature and for the surroundings in which you do so. Nothing in this Section shall be construed as granting any license to the AirTouch implementation itself, which remains Content and Design within the meaning of these Terms.
14. Enforcement and Remedies
Any unauthorized use, reproduction, or exploitation of the Website, its Content, its Design, or the Projects constitutes an infringement of the intellectual property rights of Sherwin Vishesh Jathanna and a material breach of these Terms. In the event of such infringement or breach, the Owner reserves the right to pursue any and all remedies available at law or in equity, in any applicable jurisdiction, including without limitation injunctive relief, actual damages, statutory damages where available, disgorgement of profits, and recovery of reasonable attorneys' fees and costs. You acknowledge that unauthorized use of the Content may cause irreparable harm for which monetary damages would be an inadequate remedy, and that the Owner shall be entitled to seek equitable relief without the necessity of posting a bond.
15. Disclaimer of Warranties
The Website and all Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, completeness, or non-infringement. Sherwin Vishesh Jathanna does not warrant that the Website will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Website or the servers that make it available are free of viruses or other harmful components. The information on the Website is provided for general informational purposes only and should not be relied upon as professional advice of any kind.
16. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Sherwin Vishesh Jathanna be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, use, or goodwill, arising out of or in connection with your access to, use of, or inability to use the Website or any Content, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not the Owner has been advised of the possibility of such damages.
17. Indemnification
You agree to defend, indemnify, and hold harmless Sherwin Vishesh Jathanna from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Website in violation of these Terms, your infringement of any intellectual property or other right of the Owner or any third party, or your violation of any applicable law or regulation.
18. Severability
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.
19. Entire Agreement; No Waiver
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sherwin Vishesh Jathanna with respect to your use of the Website and supersede all prior or contemporaneous understandings. No failure or delay by the Owner in exercising any right under these Terms shall operate as a waiver of that right, and no single or partial exercise of any right shall preclude any further exercise thereof.
20. Changes to These Terms
Sherwin Vishesh Jathanna reserves the right, in his sole discretion, to revise, amend, or update these Terms at any time and without prior notice. The "Last updated" date at the top of this page will reflect the most recent revision. Your continued use of the Website following the posting of revised Terms constitutes your acceptance of those revisions. You are encouraged to review this page periodically to remain informed of the terms governing your use of the Website.
21. Governing Law and Jurisdiction
These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms or the Website, shall be governed by and construed in accordance with the laws of the United States of America and, where applicable, the laws of the State of Arizona, without regard to conflict of law principles. The foregoing shall not be construed to limit the Owner's right to enforce his intellectual property rights in any other jurisdiction in which infringement occurs, under the laws of that jurisdiction and applicable international treaties.
